GILLETTE — A 32-year-old man died last week from injuries he suffered after being accidentally run over by his girlfriend.

Now Dana Johnson, 29, faces a new charge of aggravated vehicular homicide for allegedly causing her boyfriend’s fatal injuries.

Johnson was bound over to District Court for two counts of aggravated assault, driving under the influence of alcohol with a child passenger, endangering children and leaving the scene of an accident.

But last Wednesday, her case was sent back to Circuit Court because the victim, Devyn Hendricks, had died.

On July 12, a week after the incident, Hendricks was pronounced dead. His only significant injuries were to his head and were consistent with the trauma sustained during the crash, according to court documents.

In Wyoming, aggravated vehicular homicide is a felony that carries a maximum penalty of 20 years in prison and a $10,000 fine.

On July 5, police responded to the 1900 block of Chestnut Circle after a man was reportedly run over by a car. When they got there, they found a man lying underneath a black SUV with serious injuries.

Witnesses said they saw a woman, whom they identified as Johnson, get out of the driver’s seat and run off after the crash.

Johnson was found a short time later near her apartment on East Walnut Street, about six blocks from the crash. Her breath smelled of alcohol and she appeared to be very tired from running. She told police that she was out for a walk, according to court documents.

She agreed to speak with officers and was taken to the police department for an interview. She said her boyfriend, Hendricks, was hit by the car. They were at the Montgomery Bar when he received a call from his 10-year-old son, who said his mother’s boyfriend had punched him in the head.

Johnson drove Hendricks in a Cadillac Escalade to the 1900 block of Chestnut Circle, where the boy’s 30-year-old mother, Hendricks’ ex-girlfriend, lived. Hendricks got out and began arguing with his ex. The 10-year-old and his younger brother got into Johnson’s car, and she drove away because she didn’t want them to see the fight.

She said she tried to calm the boys down for a few minutes, then drove back to pick up Hendricks. The boys got out of the car and left the doors open. Johnson said the other woman got into the passenger seat and started hitting her in the head.

Johnson remembered seeing Hendricks standing in front of the SUV as she was being hit. In an attempt to stop the other woman from hitting her, Johnson drove forward. She hit Hendricks before coming to a stop.

Johnson said she panicked and ran home because she didn’t know what to do, according to court documents.

Johnson completed field sobriety tests but said she didn’t believe she should be driving. At the jail, nearly two and half hours after the crash, she took a breath test, resulting in a blood alcohol content of 0.065%.

Police then interviewed the other woman. She said that when Johnson and Hendricks first arrived, Hendricks got out of the car, and her two sons, whom she shares with Hendricks, got into the car. Johnson then drove off and was gone for 10 to 15 minutes.

The woman said this upset her. She didn’t want Johnson around her sons because Johnson had displayed “concerning behavior” in the past. This led to her getting into an argument with Hendricks, according to court documents.

When Johnson returned, the other woman opened the driver’s side passenger door. She said Johnson “floored it” at that moment, dragging her for a short distance. Her boyfriend helped her back up just before she saw Hendricks being run over.

Neighbors provided surveillance footage of the incident. Johnson can be seen pulling into a cul-de-sac, and Hendricks exits. A boy is seen getting into the SUV, which drives off before returning a short time later.

When the Cadillac returns, the woman can be heard screaming, “Give me my motherf–ing kid.” Johnson comes to a stop, and three people appear in her headlights. The mother of the boys goes up to the SUV, opens the driver’s side passenger door, and Johnson accelerates, knocking the other woman to the ground and running over Hendricks, who was standing near the front of the car.

A forensic interview was conducted with Hendricks’ 10-year-old son. He said he and his brother got into Johnson’s car because they didn’t want to be at the home anymore. Johnson drove a block away.

The boy said he realized he had forgotten his phone, and Johnson drove back to the home, according to the affidavit. At this point in the interview, the boy said he didn’t want to talk about it anymore.

Based on the investigation, police believe Johnson disregarded a “substantial and unjustifiable risk” that her actions would result in serious injury or death, accelerating forward while knowing that Hendricks was right in front of the SUV.

Earlier that week, Johnson had been bound over to District Court for possession of meth and marijuana.

Police found drugs in Johnson’s apartment, as well as paraphernalia. A search of the apartment turned up a digital scale, a black container and a jeweler’s baggie, all of which contained meth residue. Children’s laundry was found in the bedroom where these items were located. Johnson has two previous convictions for drug possession from August 2024.
