Black Hills Energy Public Notice — May 14, 2026
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Regulations, a procedural schedule for the above docketed matter has been established and notice is hereby given that a public hearing is scheduled regarding the formal complaint of Susan Shaffer (Ms. Shaffer or the Complainant) against Black Hills Wyoming Gas, LLC d/b/a Black Hills Energy (BHWG or the Company) for going beyond the right of way easements on her property and damaging private property. The public hearing is set to commence on Thursday, June 25, 2026, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.
1. BHWG is a public utility, subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(D) and 37-2-112.
2. On November 20, 2025, Ms. Shaffer, a current gas customer of BHWG, filed her complaint and request for a formal hearing to address the alleged violation of right of way easements on her property and subsequent damage to the property.
3. On November 25, 2025, the Commission issued the Complaint Letter to BHWG to the Company outlining the complaint and requesting a response. On December 15, 2025, BHWG filed its Response to Formal Complaint (Response) and request to dismiss (Request) addressing the issues raised, including easement and utility locations, and requesting the Commission dismiss the request.
4. On December 17, 2025, the Commission issued the PSC Letter to Shaffer outlining BHWG’s Response. On January 6, 2026, Ms. Shaffer filed a response to the Company’s Response refuting or disagreeing with the Company’s statements, recommendations, and request that the Commission dismiss the complaint.
5. On March 24, 2026, pursuant to open meeting action, the Commission considered the Company’s Response and Request and denied its request to dismiss.
6. No resolution of the complaint or situation has been achieved. In an effort to allow meaningful participation among all parties and interested persons and address the unresolved complaint and issues in the above-captioned matter, a public hearing has been established.
7. All interested persons are encouraged to attend the public hearing which will be conducted in accordance with the Wyoming Administrative Procedure Act and Wyoming Public Service Commission Rules. All interested persons may appear and be heard in person, by video or telephone conference, or through counsel appearing in person or by video or telephone conference.
