FORECLOSURE SALE NOTICE
 
WHEREAS, to the lack of occupancy in the property, a default has occurred under the terms of a Promissory Note (the “Note”) dated March 12, 2008, executed and delivered by David G. Paulley and Elsie Marie Woodard (“Mortgagors”) to Cherry Creek Mortgage Co., Inc., and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagors, to said Mortgagee, and which Mortgage was recorded on March 17, 2008, at Reception No. 701924, in Book 305, at Page 0319 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Weston County, State of Wyoming; and
WHEREAS, the Mortgage was assigned for value as follows:
Assignee: Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust
Assignment dated: October 26, 2021
Assignment recorded: November 1, 2021
Assignment recording information: at Reception No. 770849, in Book 403, at Page 997
All in the records of the County Clerk and ex-officio Register of Deeds in and for Weston County, Wyoming.
WHEREAS, a Judgment was entered by the Weston County District Court on March 31, 2022 and recorded on April 7, 2022, in Book 406, at Page 938, at Reception No. 771472, for the amount of $159,041.97, plus interest, costs expended, late charges, and attorney’s fees accruing thereafter through the date of sale, and ordering the foreclosure of the real property referenced below pursuant to Wyoming’s Foreclosure Statutes; and
WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;
WHEREAS, if the foreclosure sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of his/her/its money paid.  The Purchaser shall have no further recourse against the Mortgagee, Mortgagor, Servicer or their attorneys;
NOW, THEREFORE Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust, as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Weston County, Wyoming to the highest bidder for cash at 10:00 o’clock in the forenoon on June 7, 2022 at the Weston County Courthouse located at 1 West Main, Newcastle, WY 82701, for application on the above described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:

Starting at the intersection of the West boundary of the CB&Q Railroad right-of-way with the North boundary of the SW1/4 of the NE1/4 of Section 9, Township 46 North, Range 63 West; thence running S15°26’E along the West boundary of the CB&Q Railroad right-of-way for a distance of 391.4 feet to a jog in the right-of-way; thence S73°12’W 50 feet to a jog in the right-of- way line; thence S13°56’E along the West boundary of the CB&Q Railroad right-of-way for a distance of 252 feet to the point of beginning; thence S73°12’W for a distance of 193.4 feet to intersect the East boundary of the former U.S. Highway #16; thence S16°48’E along the East boundary of former U.S. Highway #16 for a distance of 113.0 feet; thence N73°12’E for a distance of 130 feet; thence S16°48’E for a distance of 75 feet; thence N73°12’E for a distance of 54 feet to intersect the West boundary of the CB&Q Railroad right-of-way; thence N13°56’W along the West boundary of the CB&Q Railroad right-of-way for a distance of 188.5 feet to the point of beginning

Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.
